En tant que soci\u00e9t\u00e9 immobili\u00e8re, Sotheby\u2019s International Realty Canada s\u2019attend \u00e0 ce que des acheteurs \u00e9trangers qui restent admissibles \u00e0 s\u2019acheter une propri\u00e9t\u00e9 r\u00e9sidentielle au Canada poursuivent leur recherche et l\u2019achat de propri\u00e9t\u00e9s au pays.<br \/>\n<strong><br \/>\nQUI EST VIS\u00c9 PAR CETTE INTERDICTION?<\/strong><\/p>\n<ul>\n<li aria-level=\"1\">La loi vise les citoyens non canadiens, ainsi que les soci\u00e9t\u00e9s non canadiennes, c\u2019est-\u00e0-dire celles qui ne sont pas constitu\u00e9es par une loi f\u00e9d\u00e9rale ou provinciale, ou les soci\u00e9t\u00e9s constitu\u00e9es par une loi f\u00e9d\u00e9rale ou provinciale dont la propri\u00e9t\u00e9 directe ou indirecte par un non-Canadien repr\u00e9sente 3&nbsp;% ou plus de la valeur des capitaux propres ou des droits de vote.<\/li>\n<li aria-level=\"1\">Il existe cependant plusieurs exceptions qui sont assujetties \u00e0 des conditions diverses et complexes.<\/li>\n<\/ul>\n<p><strong>QUI EST EXEMPT\u00c9 DE L\u2019INTERDICTION?<\/strong><\/p>\n<p>L\u2019interdiction ne s\u2019applique PAS aux personnes suivantes&nbsp;:<\/p>\n<ul>\n<li aria-level=\"1\">les citoyens canadiens ou r\u00e9sidents permanents;<\/li>\n<li aria-level=\"1\">l\u2019\u00e9poux ou le conjoint de fait d\u2019un citoyen canadien, d\u2019un r\u00e9sident permanent, d\u2019une personne inscrite en vertu de la Loi sur les Indiens ou d\u2019un r\u00e9fugi\u00e9;<\/li>\n<li aria-level=\"1\">les non-Canadiens qui veulent louer une propri\u00e9t\u00e9 r\u00e9sidentielle au Canada;<\/li>\n<li aria-level=\"1\">les r\u00e9sidents temporaires inscrits \u00e0 un programme d\u2019\u00e9tudes autoris\u00e9 dans un \u00e9tablissement d\u2019enseignement d\u00e9sign\u00e9 (tel que d\u00e9fini par le R\u00e8glement sur l\u2019immigration et la protection des r\u00e9fugi\u00e9s), qui r\u00e9pondent aux crit\u00e8res d\u2019admissibilit\u00e9;<\/li>\n<li aria-level=\"1\">les r\u00e9sidents temporaires dot\u00e9s d\u2019un permis de travail valide ou d\u2019une autorisation de travailler au Canada, qui r\u00e9pondent aux crit\u00e8res d\u2019admissibilit\u00e9;<\/li>\n<li aria-level=\"1\">les r\u00e9fugi\u00e9s, les r\u00e9sidents temporaires qui prouvent qu\u2019ils fuient un conflit et ceux qui font une demande d\u2019asile;<\/li>\n<li aria-level=\"1\">les membres accr\u00e9dit\u00e9s de missions \u00e9trang\u00e8res au Canada.<\/li>\n<\/ul>\n<p><strong>Important&nbsp;:&nbsp;<\/strong>ces exceptions sont assujetties \u00e0 des conditions diverses et complexes. Si vous travaillez avec un client non canadien qui pourrait faire l\u2019objet d\u2019une exception, vous devez l\u2019envoyer consulter un professionnel tiers (comme un avocat ou un comptable) pour \u00e9tablir son admissibilit\u00e9.<\/p>\n<p><strong>QUELS TYPES DE BIENS SONT VIS\u00c9S PAR L\u2019INTERDICTION?<\/strong><\/p>\n<ul>\n<li aria-level=\"1\">La loi s\u2019applique aux immeubles r\u00e9sidentiels, dont les maisons individuelles ou les b\u00e2timents similaires, ainsi que les maisons jumel\u00e9es, les maisons en rang\u00e9e, les logements en copropri\u00e9t\u00e9 et autres locaux semblables, qui sont situ\u00e9s dans une r\u00e9gion m\u00e9tropolitaine de recensement ou une agglom\u00e9ration de recensement. Une r\u00e9gion m\u00e9tropolitaine de recensement compte une population totale d\u2019au moins 100&nbsp;000&nbsp;habitants, dont au moins 50&nbsp;000 vivent dans son noyau, et une agglom\u00e9ration de recensement compte un noyau urbanis\u00e9 d\u2019au moins 10&nbsp;000&nbsp;habitants.<\/li>\n<li aria-level=\"1\">Cela signifie que l\u2019interdiction impos\u00e9e aux acheteurs \u00e9trangers ne s\u2019applique pas aux non-Canadiens qui ach\u00e8tent une propri\u00e9t\u00e9 r\u00e9sidentielle \u00e0 l\u2019ext\u00e9rieur d\u2019une r\u00e9gion m\u00e9tropolitaine de recensement ou d\u2019une agglom\u00e9ration de recensement.<\/li>\n<\/ul>\n<p><strong>QUELS TYPES DE TRANSACTIONS IMMOBILI\u00c8RES SONT VIS\u00c9S PAR L\u2019INTERDICTION?<\/strong><\/p>\n<ul>\n<li aria-level=\"1\">Ces mesures s\u2019appliquent aux achats, d\u00e9finis comme l\u2019acquisition directe ou indirecte d\u2019un droit ou d\u2019un int\u00e9r\u00eat dans une propri\u00e9t\u00e9 r\u00e9sidentielle.<\/li>\n<li aria-level=\"1\">Elles ne s\u2019appliquent pas aux biens acquis \u00e0 la suite d\u2019un d\u00e9c\u00e8s, d\u2019un divorce, d\u2019un don ou d\u2019une s\u00e9paration.<\/li>\n<\/ul>\n<p><strong>QUELLES SONT LES SANCTIONS EN CAS D\u2019INFRACTION \u00c0 L\u2019INTERDICTION D\u2019ACHAT PAR DES \u00c9TRANGERS?<\/strong><\/p>\n<ul>\n<li aria-level=\"1\">Des sanctions importantes sont pr\u00e9vues en cas d\u2019infraction \u00e0 la loi.
