{"id":19492,"date":"2023-03-30T14:13:29","date_gmt":"2023-03-30T18:13:29","guid":{"rendered":"https:\/\/sothebysrealty.ca\/insightblog\/en\/?p=19492"},"modified":"2023-03-31T16:26:58","modified_gmt":"2023-03-31T20:26:58","slug":"what-the-latest-changes-to-the-foreign-buyers-ban-means-to-you","status":"publish","type":"post","link":"https:\/\/sothebysrealty.ca\/insightblog\/en\/2023\/03\/30\/what-the-latest-changes-to-the-foreign-buyers-ban-means-to-you\/","title":{"rendered":"What the Latest Foreign Buyers Ban Changes Means to You"},"content":{"rendered":"<p><\/p>\n<blockquote><p><span style=\"font-weight: 300;\">On March 27, 2023, the federal government announced <\/span><a href=\"https:\/\/assets.cmhc-schl.gc.ca\/sites\/cmhc\/professional\/housing-markets-data-and-research\/housing-research\/consultations\/prohibition-purchase-residential-property-non-canadians-act\/prohibition-purchase-residential-property-non-canadians-regulations-amendment.pdf?rev=cf655bc0-d1a9-48a1-a0d5-6ea9b32788e9\"><span style=\"font-weight: 300;\">important amendments<\/span><\/a><span style=\"font-weight: 300;\"> to the <\/span><a href=\"https:\/\/www.gazette.gc.ca\/rp-pr\/p2\/2022\/2022-12-21\/html\/sor-dors250-eng.html\"><span style=\"font-weight: 300;\">Prohibition on the Purchase of Residential Property by Non-Canadians&nbsp;Act<\/span><\/a><span style=\"font-weight: 300;\"> (\u201cthe \u201cForeign Buyers Ban\u201d, which came into effect in Canada on January 1, 2023) to enhance the flexibility of newcomers and businesses looking to add to Canada&#8217;s housing supply. <\/span><span style=\"font-weight: 300;\">It is very important for you, your agent, and your broker to understand these updates so that you can seek advising from an appropriate legal or financial third-party professional, when necessary.<\/span><\/p>\n<p><span style=\"font-weight: 300;\">There are four key changes to be aware of:&nbsp;&nbsp;<\/span><\/p>\n<ul>\n<li style=\"font-weight: 300;\" aria-level=\"1\"><span style=\"font-weight: 300;\"><span style=\"font-weight: 300;\"><span style=\"font-weight: 300;\">People who hold a work permit or are authorized to work in Canada under the Immigration and Refugee Protection Regulations are now allowed to purchase residential property. Work permit holders are eligible if they have 183 days or more of validity remaining on their work permit or work authorization at the time of purchase, and they have not purchased more than one residential property. The current provisions on tax filings and previous work experience in Canada are also being repealed.<\/span><\/span><\/span>&nbsp;<\/li>\n<li style=\"font-weight: 300;\" aria-level=\"1\"><span style=\"font-weight: 300;\"><span style=\"font-weight: 300;\"><span style=\"font-weight: 300;\">Vacant land zoned for residential and mixed-use can now be purchased by non-Canadians and used for any purpose by the buyer, including for residential development.<\/span><\/span><\/span>&nbsp;<\/li>\n<li style=\"font-weight: 300;\" aria-level=\"1\"><span style=\"font-weight: 300;\"><span style=\"font-weight: 300;\"><span style=\"font-weight: 300;\">There is now an exception allowing non-Canadians to purchase residential property for the purpose of development. The amendments also extend the exception currently applicable to publicly traded corporations under the Act, to publicly traded entities formed under the laws of Canada or a province and controlled by a non-Canadian.<\/span><\/span><\/span>&nbsp;<\/li>\n<li style=\"font-weight: 300;\" aria-level=\"1\"><span style=\"font-weight: 300;\">The corporation foreign control threshold has increased from 3% to&nbsp;10% for the purposes of the prohibition, with regards to privately held corporations or privately held entities formed under the laws of Canada or a province and controlled by a non-Canadian.
